Please read these Terms and Conditions carefully before booking a driving course with Passfastacademy. By making a booking or payment, you are agreeing to the terms outlined below. These govern your relationship with us and our affiliated instructors.
- Introduction and Definitions
1.1 “Passfastacademy”, “we”, “us” or “our” refers to the trading name under which we provide driving courses across Southampton and surrounding areas.
1.2 “You” or “your” refers to the person booking the course, and/or the learner driver receiving driving instruction.
1.3 “Instructor” refers to a DVSA-approved driving instructor allocated by us to deliver the driving lessons included in your course.
1.4 “Course” or “Package” means the driving tuition package selected and paid for by you, consisting of a set number of lesson hours with a qualified instructor.
1.5 “DVSA” refers to the Driver and Vehicle Standards Agency.
1.6 “Agreement” means the contract between you and Passfastacademy, formed at the point of booking and payment. - Booking and Course Requirements
2.1 By booking a course, you confirm that you hold or are eligible to hold a valid UK provisional driving licence.
2.2 After booking, you must complete a student information form in full. We will use this to match you with a suitable local instructor.
2.3 You may be asked to provide preferred lesson days, times, and any availability restrictions. While we will try to accommodate preferences, we cannot guarantee all requests.
2.4 Passfastacademy acts as an intermediary between you and your instructor. Booking a course confirms your agreement for us to match you with a suitable instructor based on your location and requirements.
2.5 You are responsible for independently booking your own DVSA practical driving test through the official DVSA website (gov.uk). Passfastacademy does not book, manage, or guarantee test dates on your behalf. - Instructors and Lessons
3.1 Our instructors are self-employed, DVSA-approved, and insured. Passfastacademy acts as an intermediary to match you with a suitable instructor in your area.
3.2 Your agreement for lessons is with your instructor directly. Passfastacademy is not liable for the instructor’s conduct, punctuality, or vehicle issues, though we will investigate serious complaints and reallocate instructors where appropriate.
3.3 You must communicate directly with your instructor to confirm lesson times, pick-up locations, and any changes to your schedule.
3.4 Instructors reserve the right to cancel or refuse lessons for safety concerns, lack of documentation, or if the student appears unfit to drive (e.g. under the influence of alcohol or drugs).
3.5 Any missed or late-arrival lessons cancelled without at least 48 hours’ notice may be forfeited without refund.
3.6 Your instructor will provide honest, structured feedback on your progress and advise you when they consider you ready to sit your practical test. However, the decision to book a test remains yours. - Payments and Refunds
4.1 Full payment for your chosen course package is required at the time of booking to confirm your place.
4.2 Payments are handled securely via Stripe or other integrated payment partners. Where instalments are used (e.g. Klarna, PayPal Pay-in-3), the instalment agreement is between you and the payment provider, not Passfastacademy.
4.3 Once payment is made and an instructor is assigned, refunds are not typically available. In exceptional circumstances, refunds may be considered subject to an administrative fee and deduction of any instructor fees already incurred.
4.4 A full refund will be issued if Passfastacademy is unable to match you with a suitable instructor within 14 days of your booking.
4.5 Refunds will not be issued for lessons already completed, or for test failures, as these are outside our control. - Test Preparation and Readiness
5.1 Passfastacademy provides driving tuition to prepare you for your DVSA practical test. We do not book, reschedule, or manage test appointments on your behalf.
5.2 You are responsible for booking your own practical test via the DVSA website at gov.uk/book-driving-test. We strongly recommend booking your test only when your instructor has confirmed you are ready.
5.3 If you book a test before completing sufficient lessons or against your instructor’s advice, Passfastacademy accepts no responsibility for any resulting test failure or wasted test fee.
5.4 Your instructor’s car may be available for use on your test day subject to prior agreement. This is arranged directly between you and your instructor and may incur an additional fee. - Changes and Cancellations
6.1 You may request to change your course package, instructor, or lesson schedule. Any changes are subject to instructor availability and may incur an administrative fee.
6.2 If you relocate or your availability changes significantly, we will do our best to accommodate you with a suitable instructor in your new area, but delays or additional costs may apply.
6.3 Refunds will not be given for missed lessons or failed tests unless the failure was directly due to fault on our part. - Conduct and Responsibilities
7.1 You must bring a valid UK provisional driving licence to all lessons. Failure to do so may result in the lesson being forfeited.
7.2 You must behave respectfully toward your instructor and Passfastacademy staff at all times. Abusive or threatening behaviour will result in immediate termination of your course with no refund.
7.3 You must be punctual, appropriately dressed, and must not be under the influence of alcohol, drugs, or any substance that may impair your ability to drive safely. - Liability
8.1 Passfastacademy is not responsible for the actions of third parties, including instructors, the DVSA, test centres, or payment processors.
8.2 We are not liable for any test failures, cancellations due to weather, illness, or other circumstances beyond our reasonable control.
8.3 Our total liability to you shall not exceed the value of the course fee paid. - Data and Communication
9.1 Your personal data will be used solely to arrange your course and match you with a suitable instructor, in line with our Privacy Policy.
9.2 We may contact you via WhatsApp, email, or phone for booking updates, lesson arrangements, and course communications. Marketing messages will only be sent with your consent.
9.3 Your data may be shared securely with your allocated instructor as needed to fulfil your course. - Complaints
10.1 If you are unhappy with your instructor, lessons, or any aspect of our service, please contact us by email at passfastacademy@gmail.com.
10.2 We aim to respond to all complaints within 5 working days and to resolve them fairly within 10 working days. - Legal and Miscellaneous
11.1 These terms are governed by the laws of England and Wales. Any disputes may be settled in courts located in your area of residence within the UK.
11.2 Passfastacademy reserves the right to update these terms at any time. Significant changes will be communicated to active customers.
11.3 Course availability, instructor availability, and fees are subject to change. Current pricing is always displayed on our website.
